EaT @ Green Duck – Terms & Conditions

These Terms & Conditions apply to EaT @ Green Duck and the food, catering and related services provided under the EaT @ Green Duck name. By purchasing food or services from us, using our website, participating in one of our promotions or loyalty schemes, or otherwise using our services, you agree to these Terms & Conditions.

1. About EaT @ Green Duck

EaT @ Green Duck is the food and kitchen operation based at Green Duck Brewery and is operated by EaT Cuisine Group LTD (“we”, “us” or “our”).

EaT Cuisine Group LTD and Green Duck Brewery are separate businesses. EaT Cuisine Group LTD is responsible for the food, kitchen and catering services provided under the EaT @ Green Duck name.

Green Duck Brewery is responsible for its own brewery, bar, drinks, venue and other services provided directly by Green Duck Brewery. Where our website contains information or links relating to Green Duck Brewery, these are provided for customer convenience and do not mean that EaT Cuisine Group LTD is responsible for services supplied separately by Green Duck Brewery.

2. Our Food & Menus

Our menus, specials and food offerings may change from time to time and are subject to availability.

We reserve the right to change or withdraw menu items, ingredients, portion specifications, prices, offers and availability without prior notice.

We make reasonable efforts to ensure that menu descriptions and information are accurate. However, presentation, ingredients and appearance may occasionally vary.

Images of food displayed on our website, social media, menus and promotional materials are intended to provide a reasonable representation of our products. Actual presentation may vary.

3. Allergies & Dietary Requirements

Your safety is important to us.

Customers should inform a member of staff of any food allergy or intolerance before completing an order, even if they have ordered the same item from us previously. Our team will ask about allergies when taking orders wherever reasonably practicable, but customers remain responsible for making us aware of any relevant allergy or intolerance.

Although we take reasonable precautions when preparing food, our kitchen handles multiple allergens and we cannot guarantee that any product is completely free from traces of a particular allergen where cross-contamination is possible. If you have a serious allergy or are unsure whether a menu item is suitable for you, please speak to a member of the EaT @ Green Duck team before ordering.

4. Prices

All prices will be displayed in pounds sterling (£).

Prices may change from time to time and the price applicable to your purchase will normally be the price displayed or communicated at the point your order is placed. We reserve the right to correct genuine pricing or menu errors. Where an error is identified before an order is fulfilled, we will explain this to you and give you the opportunity to proceed at the correct price or cancel the affected item.

5. Orders

At present, food orders are placed directly with our team at EaT @ Green Duck. All orders are subject to availability and acceptance.

We may be unable to accept an order where, for example, an item has sold out, equipment is unavailable, the kitchen has reached operational capacity, we cannot safely accommodate a dietary requirement, or circumstances outside our reasonable control prevent us from fulfilling the order.

Estimated preparation and collection times are provided as a guide. During particularly busy periods, actual waiting times may vary.

6. Payment

Payment must be made using one of the payment methods accepted by EaT @ Green Duck at the time of purchase.

We may use third-party payment providers to process transactions. Where a third-party provider processes your payment, its own terms and privacy practices may also apply. We do not store customers' full debit or credit card details ourselves where payments are processed securely through an external payment provider.

7. Collection of Food

Where food is ordered for collection, customers should collect their order within the advised collection period wherever possible. We cannot guarantee the quality, temperature or condition of food where an order is collected substantially later than the agreed or advised collection time.

Once food has been collected, customers are responsible for its appropriate storage, handling and consumption.

8. Changes, Cancellations, Complaints & Refunds

Because our food is prepared to order and is perishable, cancellation and refund rights applicable to some other types of purchases may not apply in the same way to prepared food.

If you wish to amend or cancel an order, please speak to a member of our team as soon as possible. We will try to accommodate your request where reasonably possible, but this may not be possible once preparation has begun.

If there is a problem with your order, please tell us as soon as reasonably possible so that we have an opportunity to investigate and, where appropriate, put things right.

Depending on the circumstances, we may offer a replacement, remake, alternative item, partial refund or full refund.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

9. Kitchen Loyalty Programme, Promotions & Offers

From time to time, EaT @ Green Duck may offer loyalty rewards, discounts, promotional offers, competitions or other incentives. Specific promotions may be subject to additional terms which will be communicated alongside the relevant offer.

Unless otherwise stated:

promotions cannot be exchanged for cash;

discounts and offers cannot necessarily be used together;

offers are subject to availability;

promotional codes or rewards may have an expiry date; and

we reserve the right to withdraw or amend a promotion where reasonably necessary.

We may refuse or cancel a loyalty reward or promotional benefit where we reasonably believe that the scheme has been misused, manipulated or used fraudulently.

10. Event Catering & Venue Hire

EaT @ Green Duck may provide food and catering services in connection with events held at Green Duck Brewery. Enquiries submitted through EaT @ Green Duck do not constitute a confirmed booking. Where venue hire itself is supplied by Green Duck Brewery, the venue booking may be subject to separate terms and conditions issued by Green Duck Brewery.

Where catering is supplied by EaT Cuisine Group LTD, additional terms relating to matters such as menu selection, guest numbers, deposits, payment deadlines, cancellations and dietary requirements may be provided as part of your catering quotation or booking.

Where separate event or catering terms are issued, those specific terms will take precedence over these general Terms & Conditions in relation to that booking.

11. Opening Hours & Availability

Kitchen opening hours are published on our website and/or other EaT @ Green Duck channels.

We make reasonable efforts to keep this information up to date. However, opening hours and food service times may occasionally change due to private events, staffing, operational requirements, maintenance or circumstances outside our reasonable control.

12. Our Website

Information provided on the EaT @ Green Duck website is provided for general information about our food, services and business. We make reasonable efforts to keep the website accurate and available but cannot guarantee that it will always be uninterrupted, error-free or completely up to date.

Our website may contain links to websites, booking systems, payment platforms or services operated by third parties. We are not responsible for the content or availability of third-party websites or services.

13. Intellectual Property

Unless otherwise stated, the EaT @ Green Duck name, branding, graphics, menu designs, written content, photography and other original material appearing on our website and promotional materials are owned by, or used with permission by, EaT Cuisine Group LTD.

Content may not be copied, reproduced, distributed or used for commercial purposes without prior permission from the relevant rights holder.

Green Duck Brewery's names, logos, trademarks and other intellectual property remain the property of their respective owner and are not claimed by EaT Cuisine Group LTD.

14. Liability

We do not exclude or limit liability where doing so would be unlawful.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot legally be excluded.

Subject to the above and to your statutory consumer rights, we will not be responsible for losses that were not reasonably foreseeable when our agreement with you was formed or for losses resulting from circumstances outside our reasonable control. If you are purchasing from us as a consumer, these Terms do not affect any rights provided to you by law.

15. Circumstances Outside Our Control

We will not be responsible for delays, closures, changes to service or inability to provide a product or service caused by events outside our reasonable control.

These may include, for example, power or equipment failures, supply shortages, severe weather, transport disruption, government restrictions or other unexpected operational circumstances. Where reasonably possible, we will try to minimise disruption and communicate significant changes to affected customers.

16. Privacy & Personal Information

Any personal information provided to EaT @ Green Duck will be handled in accordance with our Privacy Policy and applicable data protection legislation.

Where information is submitted to a third-party service provider, such as a payment, booking or form provider, that provider's privacy terms may also apply.

17. Changes to These Terms

We may update these Terms & Conditions from time to time, including where our services, ordering methods, promotions or legal obligations change.

The most recent version will be made available through the EaT @ Green Duck website and the date of the latest update will be shown at the top of this page.

19. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer, you will retain any mandatory legal protections available to you and nothing in these Terms is intended to restrict rights that cannot lawfully be restricted.
